Petition to Support the Georgia Property Owners’ Bill of Rights (SB 406)

We, the undersigned residents of Georgia and Georgia House District 105 (Buford, Dacula, and Lawreceville), call on our state lawmakers to support and pass Senate Bill 406, the Georgia Property Owners’ Bill of Rights Act. This legislation is urgently needed to ensure fairness, transparency, and accountability in the governance of Homeowners Associations (HOAs) across our state.

For years, homeowners have reported:

  • Excessive or arbitrary fines

  • Lack of financial transparency

  • Poor communication from HOA boards

  • Escalating legal fees

  • Foreclosures triggered by small or disputed balances

  • Limited access to records and decision‑making

 

SB 406 addresses these issues by:

  • Requiring all HOAs to register annually with the Georgia Secretary of State

  • Prohibiting unregistered HOAs from collecting dues or initiating foreclosures

  • Creating a state board to review homeowner complaints

  • Increasing the minimum debt required for foreclosure

  • Ensuring homeowners have access to records, proper meeting notices, and voting protections

These reforms do not weaken HOAs — they strengthen communities by ensuring HOAs operate fairly, transparently, and in accordance with Georgia law.

We urge the Georgia General Assembly to pass SB 406 and protect the rights of homeowners across our state.
