Fmr. Rep. Farooq Mughal declared His Intention to Introduce the Immigration and Customs Enforcement Accountability Act

Dacula, Georgia - Former Georgia State Representative and candidate for Georgia House District 105, Farooq Mughal, declared his intention to propose the Immigration and Customs Enforcement Accountability Act. This bill aims to enhance due-process protections, boost transparency, and set statewide guidelines for the interactions between state and local agencies and U.S. Immigration and Customs Enforcement (ICE).


I had the honor of being the President of the FBI Atlanta Citizens' Academy Alumni Association. Additionally, I served as the Chairman of the Gwinnett County Community Outreach Board and worked in the Gwinnett Prosecutor's Office. I have firsthand experience with the significance of accountability and civic engagement.

The legislation responds to growing concerns about unlawful detentions, lack of oversight, and inconsistent practices across Georgia jurisdictions. The bill requires a judicial warrant before any individual can be detained solely on the basis of an ICE detainer request — a safeguard that aligns with constitutional standards and federal court rulings.


“Our goal is simple: protect the rights of Georgia residents and ensure that any cooperation with federal immigration authorities is lawful, transparent, and accountable,” said fmr. State Representative Farooq Mughal. “This bill does not interfere with federal immigration enforcement. It ensures that Georgia agencies follow the Constitution and avoid costly legal liability.”

Key provisions of the bill include:


  • Prohibiting detentions based solely on ICE detainer requests without a judicial warrant

  • Requiring written notice of rights before ICE interviews individuals in custody

  • Banning racial profiling and immigration‑based stops without legal authority

  • Mandating quarterly public reporting of all ICE requests and actions

  • Establishing the Georgia Immigration Oversight Review Board to investigate complaints and issue annual reports

  • Providing civil remedies for individuals unlawfully detained


Farooq Mughal, along with several business owners and residents of House District 105 say the legislation will strengthen community trust, reduce legal exposure for counties and municipalities, and ensure consistent statewide standards.


The bill will be formally introduced during the 2027 legislative session.
